A Federal High Court sitting in the Federal Capital Territory, Abuja on Monday dismissed the suit filed by Dino Melaye, the Senator representing Kogi West Senatorial District which challenged the validity of the recall process instituted against him by his constituents.
In his judgment, Justice Nnamdi Dimgba of the Federal High Court ordered the Independent National Electoral Commission (INEC) to proceed with the recall process, effectively terminating the earlier ex parte order made by Justice John Tsoho of the Federal High in Abuja on July 6 directing both parties to maintain the status quo.
Contrary to Melaye’s claim that he was not placed on notice or given the privilege of fair hearing before the recall process began, Justice Dimgba ruled that the provisions of the law do not require INEC to give Melaye fair hearing before it could carry out its work on the recall process.
The judge ordered that the process of recalling Senator Melaye should proceed, subject to the service of the petition and the full list and signatures of the constituents in support of the recall process.
