A Federal High Court sitting in Abuja on Monday struck out the ex parte motion filed by the Attorney General of the Federation and Minister of Justice, Abubakar Malami seeking to stop the probe into the circumstances surrounding the recall of the former Pensions Reform boss, Abdulrasheed Maina.
Justice Binta Nyarko of the Federal High Court turned down Malami’s application in chambers and ordered the applicant to put the National Assembly on notice as there was no urgency in granting an ex parte motion.
The Senate had on October, 24, 2017 mandated its committees on public service, internal affairs, anti-corruption, establishments and judiciary to probe the circumstances of Maina’s secret reinstatement into the nation’s civil service.
However, Malami who had denied any involvement in Maina’s recall, had asked the court to determine whether the National Assembly had the right to probe issues relating to the ‘employment, attendance at work, disengagement, reinstatement and/or promotion of a civil servant.’
He had argued that such matters were outside the exclusive and concurrent legislative lists as contained in the 1999 Constitution of the Federal Republic of Nigeria (as amended).
