The Attorney General of the Federation and Minister of Justice, Abubakar Malami has challenged the suit seeking to stop the removal of Dr. Bukola Saraki as Nigeria’s Senate president.
Malami challenged the court’s jurisdiction to entertain the suit filed by two senators of the opposition Peoples Democratic Party, describing their action as mischievous.
He urged the Federal High Court in Abuja to hands off the case instituted by the two former All Progressives Congress senators, Rafiu Adebayo and Isa Misau.
The AGF said the lawmakers were mischief makers who had failed to establish the need to institute the action, as according to him, the lawmakers failed to show that the Senate president’s removal would affect his personal rights.
In a preliminary action to the suit marked FHC/ABJ/CS/843/2018, Malami accused the lawmakers of crying more than the bereaved on the matter.
Senators Adebayo and Misau had in their suit alleged that some members of the APC led by the party’s National Chairman, Adams Oshiomhole had perfected plans to use force against Saraki to vacate his position as president of Nigeria’s eight senate.
The duo also applied for an order of the court seeking to stop the impeachment of Saraki as the leader of the Senate. Misau in a 13-paragraphed affidavit said the APC was collaborating with key security agencies and the AGF to ensure Saraki’s removal.
In his objection, the AGF urged the court to decline jurisdiction to entertain the suit, arguing that the suit lacked merit.
