A Federal High Court sitting in Kano on Monday nullified the primary conducted by the Peoples Democratic Party in Kano State which produced Abba Kabir-Yusuf as the party’s governorship candidate in the state.
The nullification followed a suit filed by one of the party’s governorship aspirants, Alhaji Ibrahim Ali-Amin, who had approached the court to challenge the legitimacy of the process which saw Kabir-Yusuf’s emergence as candidate.
In the suit, Al-Amin had alleged that the leadership of the PDP had during the primary ‘sidelined and booted him out’ of the race.
Ali-Amin had prayed the court to nullify the election on the grounds that it was grossly flawed given the manner he was sidelined without any justifiable reason after he purchased expression of interest and nomination forms.
In his judgment, Justice Lewis Alagua nullified the election on the premise that the party had no reason to stop the plaintiff from participating in the primary since he purchased the nomination form.
Justice Alagua held that denying the plaintiff the right to participate in the primary contravened the provision of the Electoral Act. He therefore ordered for a valid fresh primary before the governorship poll scheduled for Saturday, March 9.
