The Supreme court has dismissed an appeal filed by Alhaji Ahmed Aliyu challenging the election of Aminu Tambuwal as Governor of Sokoto state.
In a unanimous judgment delivered by Justice Uwani Abba-Aji, the apex court dismissed the appeal on the ground that the appellant failed to prove his allegation of non-compliance with the electoral act and accusation of over-voting.
Justice Musa Abba-Ajji noted that whereas the appellant produced 12 witnesses before the tribunal, 11 of them made their statements in the Hausa language while the English version was tendered in evidence.
It held that Ahmed Aliyu failed to tender the original versions of the statements he tendered in evidence and also failed to produce the translator to confirm the authenticity or otherwise of the 11 statements.
The case was accordingly dismissed .
