
The Supreme Court has dismissed an application filed by Mr Emeka Ihedioha, seeking it to reverse its judgement which removed him as governor of Imo State.
In the lead verdict delivered by Justice Olukayode Ariwoola, the Supreme Court held that Ihedioha’s application to set-aside the judgement that removed him from office lacked could not be granted.
The court held that
while the position of the constitution is clear as to the finality of its judgments, the Supreme Court lacks the powers to reverse a judgement it has delivered.
In a decision by the seven-man panel of justices led by the Chief Justice of Nigeria, Justice Tanko Muhammad, the apex court indicated that the judgement it gave on January 14, which declared Hope Uzodinma of the All Progressive Congress, APC, as the validly elected governor of Imo State could not be reversed.
A member of the Supreme court panel, Justice Centus Nweze, h0wever disagreed with the lead verdict. Nweze said he was satisfied that the judgement that declared Uzodinma winner was entered in error. He also held that the Supreme Court has a duty to in the interest of justice, to set-aside its decision that was given in error.
The apex court however refused to award cost against the applicants .
