The Executive Governor of Ekiti State, Ayodele Fayose has asked the Federal Executive Council to declare President Muhammadu Buhari incapable of continuing in office by invoking Section 144 of the 1999 Constitution.
Fayose, in a statement he issued on Monday through his Special Assistant on Public Communications and News Media, Lere Olayinka, said the ruling All Progressives Congress (APC) and the cabal in Aso Rock were confused as to whether to bring back the ailing president in his present condition or leave him in London.
“For a President who has spent 113 days abroad taking care of his health out of the 191 days already spent in 2017, it is time for Section 144 of the 1999 Constitution of the Federal Republic of Nigeria to be invoked,” Fayose said.
“President Buhari left Nigeria for London on May 7, 2017 and today is July 10, 2017, 64 clear days since Nigerians saw their President or heard anything from him. Even the President’s handlers are keeping Nigerians in the dark,” he added.
He stressed that even though the number of days a sitting president can spend outside the country was not specified in the 1999 Constitution as amended, the authors of the constitution envisaged such situations hence the provisions contained in Section 144 on how to resolve it.
He therefore urged the Federal Executive Council to invoke Section 144 by passing a resolution declaring that President Muhammadu Buhari was incapacitated and incapable of carrying out the responsibilities and functions of his office.
