The Osun State Governorship Election Tribunal today, January 27, 2023 quashed the election of Mr Ademola Adeleke as governor of Osun State. It also declared Mr Gboyega Oyetola , the erstwhile governor who contested the election with him as the rightful winner of the July 16, 2022 poll.
In the judgement which was declarattive, the tribunal ordered the Independent National Electoral Commission, INEC to withdraw the Certificate of Return it issued to Adeleke and declare Oyetola as elected.
Friday’s judgement is the first judicial test of the Bimodal Voter Accreditation System, BVAS which is stipulated in the new Nigerian electoral law and adopted by INEC.
Delivering the majority judgement, Justice Testea Kume declared that in pronouncing Adeleke as duly elected, INEC did not comply with the constitution and the Electoral Act.
The tribunal arrived at its decision after deducting the excess votes in all the areas where over-voting was discovered from the total number of votes scored by each candidate. total number of votes validly scored by Oyetola became 314,921 while Adeleke’s score dropped to 290,266.
In the light of this, Justice Kume ordered INEC to issue Adegboyega Oyetola with a Certificate of Return.
