The Supreme Court on Tuesday dismissed a suit filed by Senator Samuel Anyanwu challenging the emergence of Hon. Emeka Ihedioha as the duly elected governor of Imo State.
Delivering the judgment, Justice John Okoro held that the appellant failed to prove his case beyond any reasonable doubt.
Justice Okoro said: “The appellant has failed to prove beyond a reasonable doubt the allegations against the 1st respondent, therefore the case is hereby dismissed and cost of N200, 000 awarded in favour of the first and second respondents.”
Mr. Anyanwu had approached the apex court, seeking to nullify Ihedioha’s victory during the primary elections of the People’s Democratic Party (PDP) in the state.
In the suit, Anyanwu alleged that Ihedioha engaged in electoral fraud, including over voting and thuggery which he said swayed the results of the polls in his favour.
The Appeal Court sitting in Owerri, the state capital had earlier struck out the suit challenging the emergence of Hon. Ihedioha as the governorship candidate of the PDP.
In dismissing the suit, the court held that Anyanwu failed to establish his case as he did not provide convincing evidence to back up his claims.
