The Court of Appeal has set aside an FCT High Court judgment sacking Senator Ifeanyi Ubah as the lawmaker representing Anambra South Senatorial district.
In a unanimous judgment delivered by Justice Stephen Adah, the court held that the FCT High Court acted outside its jurisdiction to entertain a matter that arose in Anambra state.
The FCT High Court’s judgement was nullified on the grounds that the originating process was incompetent having not been signed by a lawyer as required; the judgment was given without jurisdiction, and that Ubah was denied fair hearing by the FCT High Court.
Senator Ifeanyi Ubah had on January 18, filed a suit at the Court of Appeal to challenge the judgment which removed him as a lawmaker.
